Landlord not protecting deposit

Just discovered that our deposit hasn't been put into a deposit protection scheme. We move out in 5 weeks, and our final rent payment is due at the end of next week.

He doesn't seem like the dodgy sort in the slightest, and it's probably just an oversight that he's forgotten to register it, but even so...would rather avoid having to go down the route of taking him to court if it turns out he tries to hold on to it once we move out.

So anyone got any advice for how to proceed with the landlord? Should we suggest that he just uses our deposit as our final rent payment, or is there a better way to approach this?
