Quick Q.
Got a taxi home the other night from a taxi rank, problems with my card at the machine so I couldn't pay the full fare. The driver asked for something as security until I went in the following day to pay the rest of the fare. I (stupidly) gave him my phone and he drove off without giving me any details (fare owed, company/driver name, office location)

I have contacted the police and checked the cctv footage, so I know the Cab firm... they have traced which taxi it was and approached the driver, who has, unsurprisingly, denied taking it from me.

The bastard has definitely nicked it, but my question is: Am I likely to be able to claim on the insurance... because technically I did hand the phone over??
